Are there any massage therapists in the State of Montana that knows the laws regarding non-competes in Montana or can direct me to where I can obtain information.   Are they ienforceable/legal in this state?  Thanks    Kay

Hello! I'm in another state, but a few years ago, I signed a non-compete (I was desperate at the time). The job turned sour and I asked a lawyer friend to check the wording of the non-compete contract I had signed, to see if I could get out of it. She said that it appeared to be binding :( ....and I stayed at the job for several months. Eventually, the business' owners decided to lay me off!!!! I was so excited because, since it was their decision, the non-compete was void at that point! I found another job nearby, and learned a valuable lesson.

Non-competes can be tricky. This is what I would suggest: if you know a lawyer, ask them to look the contract over for you and give an opinion. Or, the state Department of Labor might have a number you can call and speak to someone about the laws in your state.

Another friend of mine works in job placement. He told me that, if you "violate" a non-compete, most companies will not bother to come after you; they don't want to go to the legal expense. I knew that, in my case, the employers probably would have tried to make trouble for me if I had violated the terms of the contract. I hope things work out for you soon.
