Comment by Frank Ansel on October 16, 2009 at 7:15am: Terri Crowder... If you are an employee the employer will give you a W-2 and the end of the year. The employer will also collect Federal Income Tax and Social Security Taxes from the wages or commissions they pay you.
If you are self-employed (your own business) the establishment will report what they pay you on a Form 1099. You will be responsible to pay your own Federal Income Tax and Self Employment Tax.

So when you are negotiating a position, ask how your earnings will be reported to you (either a W-2 or a Form 1099.) If you are going to receive a Form 1099, find an accountant or an enrolled agent for advise on what record you need to keep, what taxes need to be paid and when, and how to protect your income and not be suprised when you have to file your Federal Income Tax Return in April.

Thats right you are employed when someone else tells you your work hours and instructs you in how to so your job. If you are left to your own professional decisions AND you create your own work schedule then you are self employed and must pay your own income taxes Etc. Working on commission is a hybrid of sorts. Generally people working on commission only can be eitther but not both for the same place. lets say you work for a salon that pays you 15.00 per massage. They set your hours at 9AM-5PM and they say you cannot ask for a medical history. Then you are employed. They set your hours,commission, and how you will do your job. If you rent space in that same salon, you set your own fees,work the hours you choose, and do the massage style your most comfortable with then you are self employed.
