If independent contractors are given access to the facilities or any similar benefit that employees are offered, then the club could be found to be treating employees as IC, based on that one criteria.
Club One would be irresponsible to offer this benefit to anyone not a W-2 employee. All it takes is one disgruntled IC to land them in a world of hurt with the CA Board of Labor, which is notorious for seeing businesses as a way to close CA's budget deficit.
